Welcome to Caloree! These Terms of Service ("Terms") govern your use of the Caloree mobile application (the "App") operated by Aleksei Vladimir Volik, IE ("we", "us", or "our"). Please read these Terms carefully before using the App.
By downloading, accessing, or using the Caloree App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.
These Terms constitute a legally binding agreement between you and Aleksei Vladimir Volik, IE. Your use of the App is also subject to Apple's App Store Terms of Service.
You must be at least 13 years of age to use the App. If you are under 18 years of age, you must have permission from your parent or legal guardian to use the App. By using the App, you represent and warrant that you meet these age requirements.
Caloree is a calorie tracking and nutrition analysis application that provides:
The App uses artificial intelligence (OpenAI API) to analyze food photos and provide nutritional estimates. Access to the food scanning feature requires an active paid subscription or active free trial. While we strive for accuracy, estimates may not be 100% precise.
When you use the App, you will provide certain personal information during the onboarding process, including your gender, age, height, weight, goals, and activity level. You are responsible for providing accurate and complete information.
All your personal data, including meal history, weight tracking, and scanned photos, are stored locally on your device only. We do not store this information on remote servers. If you delete the App, all your data will be permanently deleted and cannot be recovered.
You are responsible for maintaining the security of your device. We recommend using device security features such as passcodes, biometric authentication, and encryption.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms.

The AI-powered food scanning feature requires an active paid subscription or free trial period. Without a subscription, you will not have access to the food scanning functionality.

Caloree offers premium subscription plans that provide access to additional features, including unlimited food scanning. Subscription details, pricing, and features are displayed in the App and may be updated from time to time.
Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your Apple App Store account will be charged for renewal within 24 hours prior to the end of the current period at the same price as the original subscription.
All payments are processed through Apple's App Store. Payment will be charged to your Apple App Store account at confirmation of purchase. We do not collect or store your payment information.
You can manage your subscriptions and turn off auto-renewal by going to your Apple App Store account settings after purchase. Subscriptions cannot be canceled during the active subscription period.
All purchases are subject to Apple's refund policy. We do not provide refunds directly. To request a refund, contact Apple Support or visit your purchase history in the App Store. Refund eligibility is determined by Apple in accordance with their policies.
We may offer free trials for subscription plans. If you do not cancel before the end of the free trial period, you will be automatically charged for the subscription. Any unused portion of a free trial will be forfeited when you purchase a subscription.
We reserve the right to change subscription prices at any time. Price changes will be communicated to you in advance and will take effect at the start of your next billing cycle.
NOT A MEDICAL SERVICE: Caloree is NOT a medical application and does NOT provide medical advice, diagnosis, or treatment. All features, including calorie tracking, goal setting, meal analysis, and nutritional recommendations, are for informational and educational purposes only.
The App generates recommendations based solely on the data you voluntarily provide (such as weight, goal, activity level, and time frame). These recommendations do NOT take into account:

If the App calculates a low daily calorie target based on your goals, we will display a warning to inform you of potential health risks. However, the final decision to follow any dietary plan is entirely yours, and you assume all responsibility for your health and safety.

All content, features, functionality, and intellectual property rights in the App, including but not limited to software, text, images, graphics, logos, and trademarks, are owned by Aleksei Vladimir Volik, IE or our licensors.
You may not copy, reproduce, distribute, modify, create derivative works, publicly display, or exploit any content from the App without our express written permission.
When you upload or take photos of food for analysis, you grant us a limited license to process these photos using our AI service (OpenAI API) for the sole purpose of providing you with calorie and nutritional estimates. Photos are not permanently stored and are deleted after analysis is complete.
You are solely responsible for the content you provide to the App. We are not liable for any loss or damage to your photos or data.
The App uses third-party services, including:
These third-party services are governed by their own terms of service and privacy policies. We are not responsible for the practices or content of these third parties.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.
We may update, modify, or discontinue the App or any features at any time without notice. We are not liable for any modifications, suspensions, or discontinuations of the App.
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page and may notify you through the App or via email. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
You may terminate your use of the App at any time by deleting the App from your device. If you have an active subscription, it will remain active until the end of the current billing period unless you cancel it through your Apple App Store account.
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to:
Upon termination, your right to use the App will immediately cease. All data stored locally on your device will remain on your device until you delete the App. We are not obligated to retain or provide any data after termination.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT IT WILL ACHIEVE ANY PARTICULAR RESULTS, INCLUDING WEIGHT LOSS OR HEALTH IMPROVEMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Aleksei Vladimir Volik, IE SHALL NOT BE LIABLE FOR ANY:
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Aleksei Vladimir Volik, IE and our affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the App shall be resolved through good-faith negotiations between the parties. If a dispute cannot be resolved through negotiation, it may be submitted to binding arbitration or litigation as permitted by applicable law.
If you access the App through the Apple App Store, you acknowledge and agree that:
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
No agency, partnership, joint venture, or employment relationship is created between you and us as a result of these Terms or your use of the App.
